It has never been a requirement to show proof of a license to buy a 
radio.  A person can just as easily buy a Yaesu or Kenwood as a Baofeng.

Wal-Mart sells GMRS radios and it explicitly states on the package that 
a license is required to operate.

I honestly think the only FCC mandate nowadays is Part 15, which 
essentially states that this device may not cause interference, and must 
accept whatever interference in its own operation.
